In the recent case of OTG Ltd v Barke and others UKEAT 0320/09, the EAT held that an administration will not constitute "insolvency proceedings… with a view to the liquidation of the assets of the company" under Regulation 8(7) of The Transfer of Undertakings (Protection of Employment) Regulations 2006 (“TUPE”). This means that any employees who are employed by the transferor immediately before the transfer takes place (and whilst in administration) will be transferred under TUPE.

The Court of Appeal confirmed that where a fair investigation had been carried out by an employer, only facts known to the person making the decision to dismiss the employee were relevant in determining whether the dismissal was fair.

The Ministry of Justice has confirmed that the implementation of the Bribery Act 2010 will be delayed. The Act, which will aim to prevent acts of bribery within commercial organisations, had been due to come into force in April 2011. This implementation date has now been pushed back until three months after the final version of the guidance has been published.
